TERMS AND CONDITIONS

Conditions of Participation in the IT MANAGER OF TOMORROW Conference and Associated Workshops.

§1 General Provisions
These Terms and Conditions specify the types, scope, and conditions of the services related to the “IT MANAGER OF TOMORROW” conference and its accompanying workshops, organized by Conlea Conferences Sp. z o.o., the conditions for concluding agreements for these services, and complaint procedures.

§2 Definitions
Whenever the following terms and definitions are used in these Terms and Conditions, they shall be understood as follows:

1. Conference – An event organized by Conlea Conferences Sp. z o.o., specifying the date and location, to discuss the topics described in the Conference program, which any person meeting the specified participation conditions may attend.
2. Workshop – A session organized by Conlea Conferences Sp. z o.o. to acquire, supplement, or improve professional or general skills and qualifications necessary for work, which any person meeting the specified participation conditions may attend.
3. Organizer – Conlea Conferences Sp. z o.o. If these Terms and Conditions mention the Organizer, it refers to Conlea Conferences Sp. z o.o., hereinafter referred to as the Organizer, with its registered office at Al. Zwycięstwa 96/98, 81-451 Gdynia, KRS No. 0000977798, NIP No. 5862381511.
4. Client – A natural or legal person who has decided to delegate a Participant to the Conference or Workshop.
5. Participant – A person who has been delegated by the Client to participate in the Conference. If the Client is a natural person, they are also the Client. It is permissible for the Participant to simultaneously be the Client.
6. Registration – Actions taken by the Client to register the Participant for the Conference or Workshop.
7. Registration Form – A document in a template form, either electronic or paper-based, effectively delivered to the Organizer.
8. Confirmation of Participation – An email sent by the Organizer to the Client or Participant in response to the Registration.
9. Service Platform – An information platform created by the Organizer, available via the Internet, enabling Users to access information and services offered by the Organizer or its partners, including registering for events and conducting commercial transactions.

§3 Registration

1. Registration for the Conference or Workshop may be made through the registration form available on the website of the respective Conference or Workshop. The intention to participate must be submitted in a manner leaving evidence both for the Organizer and the Client.
2. Registration for participation in the Workshop/Conference must be delivered to the Organizer by the deadline specified on the respective Conference or Workshop website, but no later than three business days before their start date.
3. Registration for the Conference or Workshop can be sent to the Organizer:

1. In electronic form through the active Registration Form available on the Conference or Workshop website;
2. In a digitized form (a scanned copy of the completed and signed Registration Form) via email to the Organizer at  events@conlea.pl

4. Registration may be submitted by any legal person, natural person, or organizational unit without legal personality (so-called defective legal entity) with legal capacity. However, if the Participant is not the Client, the will of the Client is binding.
5. Registration is binding and obliges the Client to make payment for the selected ticket entitling participation in the Conference or Workshop within the specified deadline.
6. A private individual (consumer) submitting a registration for the Conference or Workshop to the Organizer consents to the provision of services from the moment of registration submission.

§4 Price, Payment Terms

1. The price for participating in the Conference or Workshop is specified on the Organizer’s website or the registration form. It includes only what is detailed on the website in the Conference description.
2. The Organizer applies differentiated prices for participation in the Conference, depending on the payment deadline made by the Client – as specified in the Service Platform.

1. “Blind Bird” Price – applies to payments made for participation in the Conference until 31 October 2024 inclusive.
2. “Early Bird” Price – applies to payments made for participation in the Conference until 31 December 2024 inclusive or until the ticket pool is exhausted.
3. Regular Price – applies to payments made for participation in the Conference until 31 March 2025 inclusive.
4. “Last Call” Price – applies to payments made for participation in the Conference until 30 May 2025 inclusive or until the ticket pool is exhausted.
5. “Final Call” Price – applies to payments made for participation in the Conference after 31 May 2025.

3. The B2B ticket price of 9,990 PLN applies to:

1. Representatives of organizations providing training, consulting services, and technological solutions in IT management.
2. Sales specialists, (key) account managers, business developers, and all persons whose work involves acquiring contacts or building business relationships.

4. Failure to submit a registration or payment by the specified deadlines allows the Organizer to cancel a more favorable pricing offer and require the Client to pay the difference between the regular price and the “Early Bird” or “Last Call” price and the regular price.
5. The payment date is the date funds are credited to the Organizer’s bank account.
6. Participation in some Conferences and Workshops organized by the Organizer may be free of charge. Information about such workshops and the conditions for participation is available on the Organizer’s Service Platform.
7. Payments may be made by bank transfer directly to the Organizer’s account or through online payments via the PayU system. Payments should be made by the deadline specified by the Conference Organizer.
8. Upon receiving the registration and in the absence of online payment, the Organizer issues a pro forma invoice based on which the Client is obligated to make the payment to the bank account specified on the invoice.
9. Upon receiving the payment, the Organizer issues a VAT invoice to the Client.
10. The Organizer reserves the right to grant discounts on workshop participation fees beyond the framework of these Terms and Conditions.
11. Promotions and discounts are not cumulative – only one selected promotion or discount may be used.
12. Promotional and discount offers are not available to individuals who placed an order or paid for participation in the Conference before the promotional or discount offer’s start date.

§5 Participant Changes

1. The Client has the right to change the Participant for the Conference or Workshop. In such a case, the fee paid by the Client is non-refundable. The Client is obligated to notify the Organizer of the Participant change as specified in section 4 of this paragraph.
2. The Client has the right to cancel the Participant’s participation in the Conference or Workshop no later than seven business days before the start date, as specified in section 4 of this paragraph.
3. If the Client used a price other than the “Blind Bird” or “Early Bird” price, the fee is refundable to the provided bank account, less a 20% handling fee.
4. If the Client used the “Blind Bird” or “Early Bird” prices, the fee is non-refundable.
5. If the Client cancels the Participant’s participation within seven or fewer business days before the Conference or Workshop or if the Participant does not attend, the fee is non-refundable.
6. All correspondence referred to in sections 1-3 should be in writing and sent by registered mail to the Organizer’s address specified in §2 point 3 of the Terms and Conditions. A statement of withdrawal from the agreement and/or indicating a new Participant may also be submitted electronically to the email address specified in §13 section 1 of the Terms and Conditions.
7. The acceptance of the resignation or Participant change will be confirmed by the Organizer via email to the address provided in the registration form.

§6 Organization

1. The Conference and Workshop take place on the dates specified by the Organizer. The Organizer reserves the right to change the location and date of the Conference or Workshop. The Organizer will notify the Client and Participants directly, as well as through the Service Platform, no later than five days before the planned date of the Conference or Workshop.
2. Only the Organizer is authorized to record images or sound, including taking photographs, during the Conference or Workshop. It is prohibited for Participants to record images or sound or take photographs during the Conference or Workshop without prior written consent from the Organizer.
3. The Organizer reserves the right to record and distribute audiovisual materials related to the Conference or Workshop, including making them available to third parties under terms and conditions specified by the Organizer.
4. By attending the Conference or Workshop, including related events, the Participant consents to the Organizer’s use of their image, including distribution by the Organizer without time or territorial limitations, for organizational, advertising, promotional, and marketing purposes related to the Organizer’s activities, particularly in such forms as publishing on the website and including in promotional and informational materials.
5. The Organizer does not provide accommodation for Participants during the Conference or Workshop. Information on possible accommodation options presented on the Organizer’s Service Platform is for informational purposes only and cannot be the basis for any complaints or claims against the Organizer. Responsibility for utilizing such information lies with the Client or Participant.
6. The Organizer is not responsible for items belonging to Participants that may be lost, damaged, or stolen during the Conference.

§7 Obligations of the Organizer

1. The Organizer ensures that every effort will be made to guarantee the quality of the Conference and Workshops in accordance with their description.
2. The Organizer reserves the right to change the method of conducting the Conference or Workshop and its format at any time. The Organizer will promptly inform the Ordering Party and Participants directly, as well as through the Service, about any changes.
3. The Organizer reserves the right to make changes to the Conference and Workshop program, which shall not constitute grounds for financial claims.
4. The Organizer reserves the right to cancel the Conference or Workshop in case of events beyond its control, including those such as prohibitions on organizing events or other restrictions imposed by relevant public authorities. In such a case, all purchased tickets will be automatically transferred to the next edition of the Conference or Workshop organized in the following calendar year. The Ordering Party will also have the option to use the paid ticket price for other events organized by the Organizer within 12 (twelve) months from the originally scheduled start date of the Conference or Workshop, subject to prior agreement with the Organizer. If the Ordering Party is not interested in the proposed transfer options, the Organizer will refund the full amount paid within 180 days from the effective termination of the Agreement.
5. The Organizer reserves the right to refuse service to Participants whose fees have not been paid by the Ordering Party within the specified deadline.

§8 Obligations of the Ordering Party and Participants

1. Participants and the Ordering Party are obliged to read and fully accept these Terms and Conditions.
2. The Ordering Party undertakes to pay the applicable fees for paid services within the time and manner specified by the Organizer for the given Conference or Workshop.
3. The use of the Conference and Workshop by the Ordering Party and Participants in a manner contrary to the law, good customs, or the legitimate interests of the Organizer is prohibited.
4. A Participant attending the Conference or Workshop agrees to the use of their image in materials related to the event coverage.
5. Participants of the Conference or Workshop are obliged to respect the rights of other event Participants, not to disrupt the course of the Conference or Workshop, and to comply with the provisions of the Terms and Conditions or the Organizer's instructions. The Organizer has the right to refuse participation at any time to individuals who disrupt the event, violate order or safety rules, including individuals under the influence of psychoactive substances (including alcohol or drugs).

§9 Ownership and Copyright

1. When providing the Ordering Party and Participants with information disseminated through the Service, the Organizer emphasizes the necessity of respecting intellectual property rights.
2. The Organizer informs that the Service contains copyrighted documents, trademarks, and other original materials, including texts, photos, graphics, sounds, programs, and video materials. The layout and selection of the content presented in the Service constitute an independent subject of copyright protection.
3. Participants undertake to use all presented materials solely for their personal use. Modifying, copying, transmitting, publicly performing, and any commercial use of such content requires prior written consent from the Organizer or another authorized entity.
4. Participants ensure that any use of copyrighted materials on behalf of third parties (through the Service), including copying, transmitting, and publicly sharing them online, is done with the consent of the rights holders. Participants bear full responsibility for any damages resulting from behavior contrary to this provision.
5. By sharing materials via the Service, Participants consent to their use by other Participants for personal purposes. The Organizer reserves the right to edit, copy, and distribute these materials.
6. The Ordering Party and Participants are not authorized to conduct similar workshops for other entities or their employees unless otherwise agreed by the Parties.

§10 Processing and Protection of Personal Data

1. The administrator of the personal data database is Conlea Conferences Sp. z o.o., headquartered at Al. Zwycięstwa 96/98, 81-451 Gdynia.
2. Providing personal data by the Ordering Party is voluntary but necessary to fully use the Service, as well as to conclude and execute the Agreement.
3. The Organizer processes the following personal data of the Ordering Party or its representatives necessary to establish, shape the content, modify, or terminate the contractual relationship:

1. First and last name;
2. Job title;
3. Name of the Ordering Party;
4. Email addresses;
5. Landline or mobile phone number;
6. Number of additional Participants registered;
7. Address details;
8. Tax identification number;
9. Bank account number;
10. Other data identifying or enabling the identification of the Ordering Party.

4. The Organizer processes the following personal data of Participants, obtained from the Ordering Party or directly from the Participant, necessary for executing the Agreement:

1. Participant's first and last name;
2. Name of the Ordering Party who registered the Participant;
3. Email address;
4. Landline or mobile phone number;
5. Other data identifying or enabling the identification of the Participant.

5. The Organizer may process personal data of the Ordering Party or Participant for the marketing purposes of its own products and services or those of cooperating entities based on consent given by the Ordering Party or Participant.
6. The Organizer processes personal data for the following purposes:

1. Marketing purposes based on the consent of the data subject (Article 6(1)(a) of Regulation 2016/679);
2. Execution of the contract to which the data subject is a party or to take action at the request of the data subject before concluding a contract (Article 6(1)(b) of Regulation 2016/679);
3. Compliance with a legal obligation to which the controller is subject, primarily arising from tax and accounting regulations (Article 6(1)(c) of Regulation 2016/679);
4. Establishing, pursuing, or defending against claims, where the legal basis for data processing is the legitimate interest of the Organizer or a third party (Article 6(1)(f) of Regulation 2016/679).

7. The Organizer processes the personal data of the person representing the Ordering Party, the person designated by the Ordering Party for the performance of the Agreement, as well as the personal data of the Participant, for the purpose of concluding or performing the Agreement, or for the establishment, pursuit, or defense of possible claims—the legal basis for processing personal data is the legitimate interest of the Organizer or a third party (Article 6(1)(f) of Regulation 2016/679).
8. Personal data may be transferred by the Organizer to entities providing services on its behalf related to the conclusion or performance of the Agreement, including employees or collaborators of the Organizer, entities providing IT systems and IT services, postal and courier operators, entities providing legal services (including tax and debt collection services), or entities providing document archiving services. Personal data may also be transferred to authorized authorities to the extent required by applicable law.
9. Personal data will be processed by the Organizer for the duration of the performance of the Agreement or—for cases where appropriate consent has been given—for a period of five (5) years from the date of giving consent or until consent is withdrawn. The period of personal data processing may be extended by the statute of limitations period if the processing of personal data is necessary for pursuing potential claims or defending against such claims by the Administrator. After this period, the data will only be processed to the extent and for the time required by law.
10. The Ordering Party and the Participant have the right to:

1. Withdraw the given consent for the processing of personal data without affecting the lawfulness of processing carried out based on consent before its withdrawal. Consent can be withdrawn by using the appropriate link included in marketing communications or by sending a message to the Ordering Party via postal mail or electronically to the email address: privacy@conlea.pl;
2. Access their data and request its rectification, deletion, restriction of processing, as well as the right to data portability;
3. Object to the processing of personal data based on Article 21(1) of Regulation 2016/679;
4. File a complaint with the supervisory authority responsible for personal data protection if they consider that the processing of personal data violates the provisions of Regulation 2016/679.

11. Regarding personal data, the Organizer does not make automated decisions as referred to in Article 22 of Regulation 2016/679.
12. Providing personal data is voluntary. Failure to provide data will prevent the conclusion and performance of the Agreement or the provision of other services by the Organizer.
13. The submission of the completed Registration Form by the Ordering Party (clicking the "Submit Registration" button placed under the Registration Form) is equivalent to:

1. Confirmation by the Ordering Party of the authenticity and accuracy of the data entered in the form;
2. A statement that the Ordering Party has been informed about who processes their personal data, for what purpose, and on what legal basis, as well as about the rights associated with this processing;
3. Acceptance of these Terms and Conditions by the Ordering Party;
4. The Ordering Party’s consent to the processing of the provided personal data by the Organizer for marketing purposes, in particular for providing information about the Organizer’s and its partners’ activities and plans.

14.  The administrator of the Ordering Party’s personal data in the context of online payment processing for conference or workshop services is the payment operator—PayU S.A., with its registered office in Poznań, ul. Grunwaldzka 186, 60-166 Poznań, NIP 779-23-08-495 (hereinafter: Payment Operator). The Ordering Party’s personal data is processed in accordance with applicable law by the Payment Operator for service provision, archiving, and marketing purposes related to the services and products of the Payment Operator and its cooperating entities. The Ordering Party will not receive marketing and commercial information from the Payment Operator unless they consent to it. All detailed information regarding the processing of personal data by the Payment Operator is available from the Payment Operator.

§11 Special Provisions for Consumers

1. An Ordering Party who is a consumer is required to make full payment for the Conference or Workshop before the date of the Conference or Workshop. If the payment is made up to three (3) days before the Conference or Workshop, the Ordering Party is required to have proof of transfer on the day the Conference or Workshop begins.
2. An Ordering Party who is a consumer within the meaning of the Consumer Rights Act of May 30, 2014 (Journal of Laws of 2014, item 827, as amended) has the right to withdraw from any contract for the provision of conference or workshop services concluded with the Organizer without providing a reason, within 14 (fourteen) days from the date of concluding the Agreement, subject to sections 6 and 7 below.

4. The provision in section 2 above excludes the application of § 5 sections 1-3 of the Terms and Conditions.
5. The statement of withdrawal from the agreement should be made in writing. To meet the deadline specified in section 2 above, it is sufficient to send the withdrawal statement by registered mail to the Organizer’s address (Conlea Conferences Sp. z o.o., Al. Zwycięstwa 96/98, 81-451 Gdynia) before the deadline expires. The statement of withdrawal may also be submitted in electronic form and sent to the Organizer at the email address: events@conlea.pl. 6. Upon receiving the withdrawal statement from the Ordering Party, the Organizer will immediately send a confirmation of receipt to the Ordering Party’s email address provided in the Registration Form.
7. The provisions contained in Articles 27–38 of the Consumer Rights Act of May 30, 2014, concerning consumers, apply to an Ordering Party who is a natural person and enters into an Agreement directly related to their business activity, provided that the content of the Agreement indicates that it does not have a professional character for the Ordering Party, particularly as derived from the subject of their business activity made available based on the provisions on the Central Register and Information on Economic Activity.

§12 Liability

1. The Organizer stipulates that Conferences and Workshops are for informational purposes only and may not be used as a tool for making any decisions.
2. The Organizer is not liable for:

1. Any damages resulting from the use of the Conference or Workshop by the Service Recipients in a manner that is unlawful or inconsistent with the Terms and Conditions;
2. Any damages arising from the discontinuation of the Conference or Workshop if this occurs due to the fault of the Ordering Party/Participant or due to a violation of legal regulations or the Terms and Conditions;
3. Any damages arising from the use by the Ordering Party/Participant of materials, data, and information made available as part of the Conference or Workshop for economic, investment, business, or similar purposes;
4. Any damages caused by the disclosure of personal data in accordance with the Terms and Conditions.

§13 Final Provisions

1. Any comments regarding the operation of the Service and the Agreement should be submitted to the following address: events@conlea.pl.
2. Any complaints may be submitted to the Organizer in writing via traditional mail by sending a registered letter to the Organizer’s address specified in § 2 point 3) of the Terms and Conditions, as well as electronically to the Organizer’s email address specified in § 13 section 1 of the Terms and Conditions. If the data or information provided in the complaint requires supplementation, the Organizer will ask the complainant to complete the complaint before processing it. The Organizer reviews complaints within 14 (fourteen) business days from the date of submission. Complaints will not be considered after 14 (fourteen) days from the end date of the Conference or Workshop. It is recommended that the complaint submission includes:

1. The name/full name of the Ordering Party;
2. The registered address/residential address of the Ordering Party;
3. The subject of the complaint;
4. A specific complaint request;
5. Justification.

3. The governing law for the agreement between the Ordering Party and the Organizer, concerning the services provided under the conditions set forth in these Terms and Conditions, is Polish law.
4. Any disputes arising between the Organizer and an Ordering Party who is a consumer shall be resolved by the courts competent under the relevant provisions of the Code of Civil Procedure.
5. Any disputes arising between the Organizer and an Ordering Party who is not a consumer shall be resolved by the courts competent for the Organizer’s registered office.
6. The Organizer has the right to unilaterally amend the Terms and Conditions, provided that the rights of an Ordering Party who has made a payment for the provision of conference or workshop services by the Organizer are preserved. Any changes to the Terms and Conditions will be published on the Service and will take effect on the date of publication. The Organizer will inform the Ordering Party and Participants of the changes to the Terms and Conditions by posting information on the Service and sending an email notification to the Ordering Party or Participant.
7. The current and historical versions of these Terms and Conditions are available on the website www.itmtconf.com.
8. These Terms and Conditions come into effect on the date of publication on the Service and remain in force for an indefinite period.
